Privacy and Cookies Policy
Select Wealth (“we”, “us”, “our”) is committed to protecting and respecting your privacy. This Privacy and Cookies Policy explains how we collect, use and protect your personal data – both as a client and when you use www.selectwealth.co.uk – and the rights you have. It matches the Privacy Notice we give to clients, and should be read together with our Terms of Use.
Why should you read this policy?
During the course of dealing with us, we will ask you to provide detailed personal information about your existing circumstances, your financial situation and, in some cases, your health and family health history (Your Personal Data). This policy is important because it explains what we will need to do with Your Personal Data and the various rights you have in relation to it.
Who we are
Select Wealth is a trading name of Select Wealth Managers Ltd., registered in Scotland (company number SC471007), registered office 8 Deer Park, Fairways Business Park, Livingston, EH54 8AF. Select Wealth Managers Ltd. is the data controller for Your Personal Data and is registered with the Information Commissioner’s Office under registration number ZA419848. In this notice, “we”, “us”, “our” and “our Firm” mean Select Wealth.
What do we mean by “Your Personal Data”?
Your Personal Data means any information that describes or relates to your personal circumstances. It may identify you directly – for example, your name, address, date of birth and National Insurance number. It may also identify you indirectly – for example, your employment situation, your physical and mental health history, or any other information that could be associated with your cultural or social identity.
In the context of helping you with your pension, investment and/or protection requirements, Your Personal Data may include:
- title, names, date of birth, gender, nationality, civil/marital status, contact details, addresses and documents that are necessary to verify your identity;
- employment and remuneration information (including salary, bonus schemes, overtime, sick pay and other benefits) and employment history;
- bank account details, tax information, loans and credit commitments, personal credit history, sources of income and expenditure, family circumstances and details of dependants;
- health status and history, details of treatment and prognosis, and medical reports (see below for more on how we handle this type of information);
- any existing pension, investment, finance and/or insurance products and the terms and conditions relating to them.
The basis upon which we will deal with Your Personal Data
When we speak with you about your pension, investment and/or protection requirements, we do so on the basis that we are both entering into a contract for the supply of services.
In order to perform that contract, and to arrange the products you require, we have the right to use Your Personal Data for the purposes detailed below.
Alternatively, either in the course of initial discussions with you or when the contract between us has come to an end for whatever reason, we have the right to use Your Personal Data where it is in our legitimate business interests to do so and your rights are not overridden. For example, we may need to respond to requests from product providers, insurers and our compliance service provider relating to the advice we have given you, or contact you to seek feedback on the service you received.
On occasion, we will use Your Personal Data to meet obligations we owe to our regulator, the Financial Conduct Authority, or to comply more widely with any legal or regulatory obligation to which we are subject. In such circumstances, we would be processing Your Personal Data in order to meet a legal, compliance or other regulatory obligation.
The basis upon which we will process certain parts of Your Personal Data
Where you ask us to help you with, for example, your insurance or ethical investments – in particular life insurance and insurance that may help you in the event of an accident or illness – we will ask you for information about your ethnic origin and your health and medical history (Your Special Data). We will record and use Your Special Data in order to make enquiries of insurance or investment providers about products that may meet your needs, and to provide you with advice or guidance on the suitability of any product that may be available to you. We will process Your Special Data with your explicit consent or, where the law allows, where it is necessary for insurance purposes.
If you have parental responsibility for children under the age of 18, it is also very likely that we will record information on our systems that relates to those children and, potentially, to their Special Data.
Arranging certain types of insurance may involve you disclosing to us information about historic or current criminal convictions or offences (together, “Criminal Disclosures”). This is relevant to insurance-related activities such as underwriting, claims and fraud management.
We will use Your Special Data and any Criminal Disclosures in the same way as Your Personal Data generally, as set out in this policy.
Information on Special Data and Criminal Disclosures must be capable of being exchanged freely between insurance intermediaries such as our Firm and insurance providers, so that customers can secure the insurance protection their needs require.
Using our website
When you contact us through our website – for example, by booking a consultation, completing a form or emailing us – we use the details you give us (such as your name, email address, telephone number and the reason for your enquiry) to respond to you and, if you become a client, to provide our services. We do not use these details for marketing unless you have given us your consent.
How do we collect Your Personal Data?
We will collect and record Your Personal Data from a variety of sources, but mainly directly from you. You will usually provide information during our initial meetings or conversations to establish your circumstances, needs and preferences in relation to pensions, investments and protection. You will provide information to us verbally and in writing (including by email).
We may also obtain some information from third parties – for example, credit checks, information from your employer, your existing pension or investment providers, and searches of information in the public domain such as the electoral roll. If we use technology to help collect Your Personal Data – for example, software that can verify your credit status – we will only do this if we have your consent for us or our nominated processor to access your information in this way. We do not need your consent for electronic identity checks, but we will tell you how the software works and why it is used.
What happens to Your Personal Data when it is disclosed to us?
In the course of handling Your Personal Data, we will:
- record and store Your Personal Data in our paper files, on mobile devices and on our computer systems (such as websites, email, hard drives and cloud facilities). This information can only be accessed by people within our Firm, and only when it is necessary to provide our service to you and to perform any administrative tasks associated with or incidental to that service;
- submit Your Personal Data to product providers, platforms and insurers, both on paper and online via a secure portal. Providing this information to a third party is essential to progress any enquiry or application made on your behalf, and to deal with any additional questions or administrative issues that providers may raise;
- use Your Personal Data to respond to any queries you may have about any pension, investment or insurance product you take out, or to tell you about any developments relating to those products of which we become aware.
Artificial intelligence (AI)
AI is the development of computer systems that can perform tasks that typically require human intelligence, often by processing large amounts of data. To improve the quality, efficiency and accuracy of our service, we use AI tools to help with:
- drafting correspondence and documentation, such as letters and reports;
- checking our work for compliance with our internal procedures.
Everything produced with the help of AI is reviewed by us before it is used or sent to you, and the advice we give you is always our own. We only use AI tools that handle information securely. If you have any questions or concerns about the AI we use in relation to your personal information, please contact us.
Sharing Your Personal Data
From time to time Your Personal Data will be shared with:
- pension and investment providers, platforms and insurance providers;
- third parties who we believe will be able to help us with your enquiry or application, or who are able to support your needs as identified. These third parties include, but may not be limited to, our compliance advisers, product specialists, paraplanners and providers of legal services such as solicitors and estate planners (in each case where we believe this to be required due to your particular circumstances).
In each case, Your Personal Data will only be shared for the purposes set out in this policy, i.e. to progress your pension, investment and/or protection enquiry and to provide you with our professional services.
Transfers outside the UK
Some of the service providers we use – for example, for email, cloud storage and AI tools – may store or process Your Personal Data outside the UK, including in the United States. Where this happens, we make sure the transfer is protected as UK data protection law requires: for example, because the country is covered by UK adequacy regulations (including the UK Extension to the EU-US Data Privacy Framework), or because the provider has agreed to the ICO’s International Data Transfer Agreement or Addendum. You can ask us for more details.
Please note that this sharing of Your Personal Data does not entitle those third parties to send you marketing or promotional messages. It is shared so that we can properly fulfil our responsibilities to you and as otherwise set out in this policy.
Security and retention of Your Personal Data
Your privacy is important to us, and we will keep Your Personal Data secure in accordance with our legal responsibilities. We will take reasonable steps to safeguard Your Personal Data against it being accessed unlawfully or maliciously by a third party.
We also expect you to take reasonable steps to safeguard your own privacy when sending information to us – for example, not sending confidential information by unprotected email, making sure email attachments are password protected or encrypted, and only using secure methods of postage when original documents are being sent to us.
Your Personal Data will be retained by us, either electronically or on paper, for a minimum of six years following the advice or service you receive from us. Your data may be held for longer where this is needed to meet the requirements of our regulators.
Your rights in relation to Your Personal Data
You can:
- request copies of Your Personal Data that is under our control;
- ask us to explain further how we use Your Personal Data;
- ask us to correct or delete Your Personal Data, or to restrict or stop using it (we will explain the extent to which we can do this at the time of any such request);
- object to us processing Your Personal Data on the basis of our legitimate interests;
- ask us to send an electronic copy of Your Personal Data to another organisation, should you wish;
- change the basis of any consent you may have given, including consent for us to market to you in the future (and withdraw any consent in its entirety at any time).
Information from a family member or friend
Where we collect information about you from a third party, such as a family member or a trusted friend who is helping you, we will only use it to support the services described in this notice and not for any other reason.
